Terms and conditions of use.

By using Cuidalia, you agree to the terms below. Please read carefully before using our services. These terms constitute a legal agreement between you and Medunity LTDA.

1. Acceptance of Terms

By accessing or using the Cuidalia platform, whether through the website, mobile application or any other available means, you declare that you have read, understood and fully agreed to these Terms of Use and the Privacy Policy. If you do not agree with any provision, do not use our services. Registration on the platform implies automatic acceptance of these terms.

2. Definitions

For the purposes of this document: 'Platform' refers to the Cuidalia website, application and services; 'User' is any person who accesses the Platform; 'Patient' is the User who searches for and books appointments; 'Professional' is the registered healthcare professional who offers services; 'Account' is the personal profile created through registration; 'Content' covers texts, images, reviews and any information published on the Platform.

3. Service Description

Cuidalia is a technology intermediation platform that connects patients to healthcare professionals for scheduling in-person appointments. Cuidalia does NOT provide healthcare services, does NOT make diagnoses, does NOT prescribe treatments and is NOT responsible for the quality, adequacy or outcome of care provided by registered professionals. The relationship between patient and professional is independent and autonomous.

4. Registration and Account

To access features such as booking, reviews and messaging, you must create an Account with truthful, complete and up-to-date information. Only one Account per individual is permitted. The User is fully responsible for all activity performed with their credentials, including keeping passwords secure and not sharing them. Cuidalia reserves the right to suspend or terminate Accounts with false or duplicate data or those used for fraudulent purposes.

5. Patient Obligations

Patients agree to: provide truthful data during registration and booking; attend scheduled appointments or cancel in advance according to the professional's policy; not use the platform to obtain improper prescriptions; not harass, threaten or disrespect professionals; publish honest reviews based on real experiences; and not share professionals' contact details outside the platform for commercial purposes.

6. Professional Obligations

Professionals agree to: maintain an active and valid professional registration (medical license, psychology board, etc.); provide truthful information about qualifications, specialties and practice location; keep schedules updated with real availability; treat patients ethically and in accordance with their professional board standards; not cancel appointments repeatedly without justification; and respond to reviews with respect and professionalism.

7. Booking, Cancellation and No-Shows

Bookings are subject to availability indicated by the professional. Appointment confirmation does not constitute a guarantee of service in case of justified unforeseen circumstances. Patient cancellations must respect the minimum advance notice defined by the professional (default: 24 hours). Recurring no-shows without prior cancellation may result in: warning notification, temporary booking restrictions, or Account suspension. Professionals who cancel appointments repeatedly may have reduced visibility in search results.

8. Reviews and User Content

Patients may review professionals after confirmed appointments. Reviews must reflect real experiences and respect community guidelines. It is prohibited to: review professionals without having attended an appointment; publish offensive, defamatory or discriminatory content; offer or accept benefits in exchange for positive reviews; and publish personal data of third parties. Cuidalia reserves the right to moderate, edit or remove reviews that violate these rules without prior notice.

9. Payments and Plans

For patients, platform use is free. Professionals may opt for paid plans with additional features. Plan pricing, payment conditions and refund policies are detailed on the pricing page. Appointment fees are the exclusive responsibility of the professional — Cuidalia does not intermediate payments between patient and professional at this stage.

10. Intellectual Property

All Platform content, including but not limited to: brand, logo, layout, texts, images, icons, source code, algorithms and design, are the exclusive property of Medunity LTDA or licensed to it. Reproduction, copying, distribution, modification, reverse engineering or commercial use of any part of the Platform without prior written authorization is prohibited. Content published by Users (reviews, profile photos) remains the property of the author, but by publishing it, the User grants Cuidalia a non-exclusive, free, worldwide license to display it on the Platform.

11. Limitation of Liability

Cuidalia is not liable for: direct, indirect, incidental or consequential damages arising from use or inability to use the Platform; quality, safety or legality of services provided by professionals; information provided by professionals or patients that is inaccurate or outdated; temporary unavailability caused by maintenance, technical failures or force majeure; healthcare decisions made based on information available on the Platform. Cuidalia's total liability, in any case, is limited to the amount paid by the User in the last 12 months.

12. Suspension and Termination

Cuidalia may suspend or terminate your Account at any time and without prior notice in case of: violation of these Terms; provision of false information; fraudulent use of the Platform; conduct that harms other Users or Cuidalia's reputation; judicial or administrative determination. You may terminate your Account at any time in your profile settings.

13. Communications

By registering, you authorize Cuidalia to send communications via email, SMS or push notifications related to: appointment confirmations and reminders, security and terms updates, news about relevant features. Promotional communications may be disabled at any time in notification settings.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated at least 15 days in advance via email or Platform notification. Continued use of the Platform after the notification period constitutes acceptance of the new terms. If you disagree, you must terminate your Account.

15. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP are elected as competent to resolve any disputes, with waiver of any other regardless of privilege.
